1. Introduction and Acceptance of Terms

These Terms of Service ("Terms") govern your use ofthe services provided by GetAdvantage ("we," "us," or"our"), including automated booking systems, instant client responsesystems, website design, website hosting, social media management, and relatedservices (collectively, the "Services").

By purchasing, subscribing to, or using any of our Services,you ("Client," "you," or "your") agree to bebound by these Terms. If you do not agree with any part of these Terms, pleasedo not use our Services.

GetAdvantage operates as an unincorporated business entitybased in Southern California. These Terms constitute a legally bindingagreement between you and GetAdvantage.

 

2. Description of Services

2.1 Instant Replies ($99/month)

A smart chat assistant deployed on your website, Instagram,and Facebook that answers common client questions, captures lead information,and sends you instant notifications. This plan does not include online bookingfunctionality.

2.2 Smart Booking ($299/month)

Everything included in Instant Replies, plus:

•      Automated online booking synced with your calendar

•      Automatic appointment confirmations and reminders

•      Pre-booking qualification questions

•      Automated review requests after each visit

2.3 Full Autopilot ($999/month)

Everything included in Smart Booking, plus:

•      Deposit and prepayment collection at booking

•      Automated follow-up messages

•      Full CRM with client history

•      Multi-service and team scheduling

•      Monthly strategy calls

This plan is currently in development and will be available ata future date.

2.4 Website Design and Hosting

Custom website design services starting at $500 (one-timedesign fee) with ongoing hosting and maintenance at $50 per month. Websites arehosted on GetAdvantage infrastructure. See Section 7 for ownership details.

2.5 Social Media Management

Social media content creation and management services startingat $600 per month.

 

3. Account Registration and Access

GetAdvantage creates your account and provides you with logincredentials. You are responsible for maintaining the confidentiality of youraccount credentials and for all activities that occur under your account.

You agree to notify us immediately athello@GetAdvantage.agency if you become aware of any unauthorized use of youraccount or any other breach of security.

You must provide accurate, current, and complete businessinformation as required for the setup of your Services, including but notlimited to business name, services offered, pricing, hours of operation, andcontact information.

 

4. Payment Terms

4.1 Setup Fees

Certain Services require a one-time setup fee, payable in fullbefore work begins. Setup fees cover the time and resources required to build,configure, test, and launch your system. Setup fees are non-refundable oncework has commenced.

4.2 Monthly Subscriptions

Subscription fees are billed monthly in advance through ourpayment processor (Stripe). Your subscription automatically renews each monthunless cancelled. All prices are listed in US Dollars (USD). Subscriptionsbegin only after your system has been fully built and goes live.

4.3 One-Time Payments

One-time payments for website design or other custom servicesare processed through our payment platform and are due according to theschedule agreed upon at the time of purchase.

4.4 Failed Payments

If a payment fails, we will attempt to process it again. Ifpayment continues to fail, we reserve the right to suspend your Services untilthe outstanding balance is resolved. You are responsible for ensuring yourpayment method is valid and has sufficient funds.

4.5 Taxes

All fees are exclusive of applicable taxes. You areresponsible for any sales tax, use tax, or other taxes imposed by anyjurisdiction on the Services provided.

 

5. Cancellation and Refund Policy

5.1 Cancellation by Client

You may cancel your subscription at any time through yourclient dashboard (Stripe Customer Portal) or by emailinghello@GetAdvantage.agency. Cancellation takes effect at the end of your currentbilling period. Your Services will remain active until the end of the periodyou have already paid for. No partial refunds will be issued for unused timewithin a billing period.

5.2 No Refunds on Setup Fees

Setup fees are non-refundable once work has commenced. Thiscovers the time, labor, and resources invested in building and configuring yoursystem.

5.3 Subscription Refunds

Monthly subscription fees are non-refundable. If you cancel,your access continues through the end of the paid billing period.

5.4 Termination by GetAdvantage

We reserve the right to suspend or terminate your access tothe Services if you:

•      Violate these Terms

•      Fail to make timely payments

•      Use the Services for unlawful purposes

•      Engage in conduct that harms GetAdvantage, otherclients, or third parties

5.5 Effect of Termination

Upon termination of your subscription, automated systems willbe deactivated at the end of the paid period. Client data may be exported for30 days after termination. After this period, we may delete your data inaccordance with our Privacy Policy.

 

6. Service Updates and Changes

6.1 Modifications to Your System

Each subscription plan includes two (2) free modifications permonth, such as updating prices, hours, services, or business information.Additional modifications may incur additional fees.

6.2 Platform Access

We may require access to third-party platforms includingFacebook Business Page and Instagram account. Access is granted throughofficial partner methods. We never request your personal login credentials.

 

7. Intellectual Property and Ownership

7.1 Your Content

You retain ownership of all content you provide, includingtext, images, logos, and branding materials. You grant GetAdvantage a licenseto use your content solely for delivering the Services.

7.2 Website Design

For websites designed and hosted by GetAdvantage, the design,templates, and code remain property of GetAdvantage during the hosting period.You retain ownership of your content. Upon termination, you may export yourcontent.

7.3 Automation Systems

Conversation flows, automation workflows, and systemconfigurations remain proprietary to GetAdvantage. You receive a license to usethese systems during your active subscription.

 

8. Client Responsibilities

You agree to:

•      Provide accurate and complete business information

•      Respond to setup communications promptly

•      Use the Services in compliance with all applicable laws

•      Not send spam or illegal content through the Services

•      Maintain responsibility for your client relationships

•      Grant necessary platform access as required for setup

 

9. SMS Communications

By providing your phone number to GetAdvantage or tobusinesses using GetAdvantage services, you consent to receive SMS messagesrelated to your service request or business interaction. These messages mayinclude:

•      Responses to service requests submitted throughplatforms such as Thumbtack

•      Appointment confirmations and scheduling updates

•      Follow-up messages regarding your request

•      Customer service communications

Message frequency may vary. Message and data rates may apply.

Opt-Out: Reply STOP at any time to opt out of SMSmessages. You will receive a confirmation and no further messages will be sent.

No Third-Party Sharing: Mobile phone numbers and SMSconsent are not shared with third parties for marketing purposes. SMS messagesare used only for communication related to requested services.

 

10. Disclaimers and Limitations

10.1 Service Availability

Services depend on third-party platforms such as Facebook,Instagram, Google Calendar, and Stripe. We cannot guarantee uninterruptedservice due to factors outside our control.

10.2 Results

GetAdvantage does not guarantee specific business results,including number of leads, bookings, or revenue. Results depend on many factorsincluding your business, market, and how you use the Services.

10.3 Automated Responses

Automated responses are based on the information you provide.You are responsible for reviewing system configuration before launch andensuring the information provided is accurate.

 

11. Limitation of Liability

To the maximum extent permitted by law, GetAdvantage shall notbe liable for indirect or consequential damages, including lost profits, lostdata, or business interruption arising from your use of the Services.

Total liability shall not exceed the amount paid by you duringthe three (3) months preceding the claim.

 

12. Indemnification

You agree to indemnify and hold GetAdvantage harmless from anyclaims, damages, losses, or expenses (including reasonable attorneys' fees)arising from:

•      Your use of the Services

•      Your violation of these Terms

•      Your violation of any applicable law or regulation

•      Content or information you provide to us

 

13. Confidentiality

Both parties agree to maintain the confidentiality ofsensitive business information shared in connection with the Services. Thisobligation survives termination of these Terms.

 

14. Governing Law

These Terms are governed by the laws of the State ofCalifornia. Any disputes shall be resolved in Orange County, California.

 

15. Changes to Terms

We may update these Terms from time to time. We will notifyyou of material changes via email or through our website. Continued use of theServices after changes constitutes acceptance of the updated Terms.

 

16. Severability

If any provision of these Terms is found to be invalid orunenforceable, the remaining provisions shall remain in full force and effect.
